A conflict that arrives eighteen months after the take-on check passed. None of these is a failure of knowledge, and all of them are what actually happens.

Forty exercises put the ordinary cases in front of you: who may be told the client's name, what an information barrier restricts and what it does not, which conflicts consent can cure and which are structural, what belongs in the first report of a breach before the facts are in, and what to do with a confidential document that should never have reached you.

There is deliberately not a single situational judgement item in this instrument. The declared instruction is knowledge and rule application throughout, because mixing what a person would do with what the duty requires produces a score that means neither. What is measured is whether the duty reaches the decision, not whether somebody can identify the espoused right answer.

Nothing here states the regulations of any one jurisdiction. Every item is keyed to duties that hold across professional codes: confidentiality that outlives the matter, the need-to-know test, a conflict as a situation rather than as conduct, and the inference you drew from confidential material being confidential even though nobody handed it to you.

Does it follow the rules in my jurisdiction?

It does not state any jurisdiction's regulations, and it is not legal advice. Every item is keyed to duties that hold across professional codes. The code that applies where you work is what applies to you, and this does not replace it.

Why are there no situational judgement items?

Because the declared instruction has to be one thing. Asking what a person would do and what the duty requires in the same instrument produces a score that answers neither question. This one asks about the duty throughout and says so.

What does the weighting decision mean?

The four parts are combined into a composite. Weighting them by reliability only earns its keep when the spread between them is above a stated threshold; below that, equal weights are used and the report says so. Either way the weights are printed next to the reliability they came from.

Is a low score a finding about my integrity?

No. Every exercise here is a question about a rule, not about a character, and the report says so in the section on what it does not measure. It carries no pass mark and should not be used on its own to decide whether somebody may work on a matter.

Methodology: Forty original exercises across six formats: fourteen keyed applications, seven select-every-that-applies exercises, seven keyed claims, five matching exercises, four ordering exercises and three most-and-least forced choices. There is deliberately no situational judgement item in this instrument: the declared response instruction is knowledge and rule application throughout, one instruction for the whole form, because mixing what a person would do with what the duty requires produces a score that means neither. Construct statement: it measures whether somebody applies a professional confidentiality and conflicts duty in the ordinary situations where it is inconvenient - internal requests, personal interests, information that has already moved, and barriers and consent. It does not state the regulations of any jurisdiction, does not certify anybody to practise, is not legal advice, and does not replace the code that applies where the respondent works. Scoring is a reliability-weighted composite (C13). Each of the four parts is chance-corrected against its own items' authored answer priors, McDonald's omega is estimated for each part from its exercise count and a stated assumed inter-item correlation, and reliability weighting is applied ONLY if the omega spread across the parts exceeds .15; below that the composite uses unit weights and the report prints that this was a decision rather than a default, because hand-tuned weights below that spread are fitting noise. The composite carries a standard error of measurement and a ninety-five per cent band drawn on the page, and any part whose omega falls under .70 carries a three-way placement instead of a number.
