Question 1: does it measure capability or collect opinion?

Ask to see what a participant actually experiences. If the instrument asks people to rate themselves, rank topics, or pick the training they would like, it is collecting opinion. If it puts people in scenarios drawn from their work and scores the judgement they demonstrate, it is measuring capability. The strongest needs analyses use both layers — opinion data for appetite and context, demonstrated-capability data for the actual gap map — but budget decisions should rest on the measured layer.

A useful test question for any demo: “show me a case where your tool told a customer that something was NOT a training gap.” A measurement tool produces that sentence routinely — some of what looks like a skills problem is a process, staffing or environment problem, and a good group report says so explicitly.
